Terms and Conditions

These terms apply to one-time purchases of MAQS Pro downloadable Windows software and permanent software licences.

Effective: 5 September 2026

1. About the purchase

MAQS Pro products are downloadable digital software supplied under a licence. The product description, price, system requirements and items included are shown on the relevant product page and at checkout. Prices are for a one-time permanent licence unless the checkout expressly states otherwise.

2. Payment and invoices

Payments are processed by Paddle, which acts as Merchant of Record for the transaction. Paddle calculates applicable taxes, takes payment and provides the customer invoice or receipt. The final price, currency and tax treatment are displayed before payment is confirmed.

3. What the customer receives

• The purchased MAQS Pro Windows software package and installer;
• a permanent licence and the applicable activation details;
• installation or user instructions supplied with the product; and
• access to the stated technical-support contact.

Delivery is made electronically to the email address supplied during checkout, normally within one UK working day after successful payment and any required payment or fraud checks. The customer must provide a correct, accessible email address and check junk or spam folders.

4. Licence

The customer receives a non-exclusive, non-transferable right to install and use the purchased software for their own professional or personal work, subject to the user, device or organisation limits stated on the product page, checkout or licence certificate. The software is licensed, not sold. The customer must not resell, sublicense, share licence credentials, remove ownership notices, or reverse engineer the software except where applicable law expressly permits it.

5. Customer responsibilities

The customer is responsible for checking the stated Windows and hardware requirements, maintaining appropriate backups and security, and reviewing outputs before relying on them. MAQS Pro assists professional measurement and estimating; it does not replace the judgement of a qualified quantity surveyor, engineer or other construction professional.

6. Support and updates

Reasonable installation and activation support is provided through the contact details on this website. Unless expressly included in the product description, a permanent licence does not guarantee every future major version, bespoke development, training or third-party software.

7. Software problems

If the supplied software cannot be downloaded, activated or used substantially as described, the customer should contact us with the order reference and a description of the problem. We will investigate and, where appropriate, provide corrected files, activation assistance, replacement or a remedy required by law. Nothing in these terms limits statutory rights that cannot lawfully be excluded.

8. Liability

Nothing excludes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any liability that cannot legally be limited. Subject to that, business customers remain responsible for professional review of calculations, quantities and project decisions. Any limitation applicable to a particular transaction remains subject to mandatory law.

9. Cancellation and refunds

The separate Refund Policy forms part of these terms. For digital content supplied immediately, consumers may be asked at checkout to consent to immediate supply and acknowledge the effect this has on the statutory cancellation right.

10. Privacy

Personal information is handled as described in our Privacy Policy. Paddle separately processes information required to operate checkout, payment, tax and invoicing services.

11. Governing law

These terms are governed by the laws of England and Wales. Consumers retain any mandatory protections and rights to bring proceedings that apply in their home jurisdiction.
